Merely being with someone is not enough. The relationship must be with an Australian citizen or permanent resident, and it must qualify as either a spousal or de facto partner relationship, which is defined by legal criteria in the Migration Act 1958

Frequently Asked Questions about Partner Visa

People often discuss the mandatory criteria that the Department must consider in assessing if relationships are authentic, which include financial, social, household, and long-term commitment factors. However, these aren’t the only considerations; each relationship is unique with its own dynamics. Contrary to common belief, having a joint bank account is not a requirement. Many prefer separate finances, which is acceptable. Every case is distinct; avoid making generic claims as they tend to be noticeable.

  • Plenty – to have circumstantial claims that can meet the definitions isn’t enough, it’s crucial to have solid evidence. You might technically fulfill the criteria, but without evidence, your claims won’t hold up. Legally, it’s your responsibility to back up your claims. The Department is not required to give you additional opportunities to provide further evidence after you submit your claim.
  • Additionally, ensure the sponsor who is either an Australian citizen or permanent resident is not restricted from sponsoring due to previous violent convictions, having sponsored multiple partners before, offenses related to children, among other things.

The requirement varies based on the type of claim. For spousal claims, no duration is specified, but for de facto partnerships, it’s typically 12 months upon application. However, there are exceptions, and registering a relationship alone isn’t sufficient. The overall duration of the relationship is always considered by the Department in each case. Approval isn’t based on a single piece of evidence but rather on a comprehensive assessment of multiple factors.

That depends on what you want us to do for you. We can check your claims and generally curate your evidence but you lodge the matter yourself. That is more costs effective. We can also do the whole thing. We will tell you what you need based on how complex or otherwise your situation is. Naturally a fuller type of service will be more of an investment. So for example, we do a lot of partner visas for HIV affected applicants. Those can be more of an investment as we will usually require a health waiver. We have had lots of claims where there has been infidelities – those are more complex but, it’s not automatic they will be refused.
